David Rebuck: Pioneering Regulation in the US Gambling Industry

David Rebuck is a renowned figure in the United States gambling industry, serving as the Director of Regulatory Affairs for the Division of Gaming Enforcement. His retirement on February 29, 2024, marks the end of an era. Rebuck'sremarkable contributions to the gambling landscape of his home state are highlighted in an analytical piece featured in a specialized publication by IGB.

Assuming the role of a gambling regulator in the 21st century presents considerable challenges. Picture this scenario: the governor has just overhauled the entire regulatory framework in your state, consolidating the powers of two agencies and abandoning traditional inspection methods at physical venues, all while introducing new digital gaming formats.

This was the exact scenario faced by David Rebuck, then a senior adviser to Gov. Chris Christie, when he was appointed as the director of the New Jersey Division of Gaming Enforcement 13 years ago. Rebuck's mandate was clear: to ensure efficient and innovative regulation, all while making swift decisions within a dynamic industry landscape.

As Rebuck steps into retirement, his legacy is celebrated with the Gaming Achievement Award, to be presented at the East Coast Gaming Congress on April 17-18 at Hard Rock Atlantic City. His tenure exemplifies a commitment to excellence and adaptation in the ever-evolving realm of gambling regulation.

Rebuck's Efforts to Foster Collaboration Between Staff and Operators

Upon David Rebuck's arrival, the Casino Control Commission, the state's primary licensing and regulatory body since 1977, had already experienced a significant loss of over 30 percent of its staff. Amidst the implementation of a new regulatory framework, further cuts were deemed necessary. These reforms were met with apprehension and uncertainty, with no guarantee of success. However, Rebuck, during his tenure as director of the New Jersey Division of Gaming Enforcement (NJDGE), implemented innovative strategies to navigate these challenges.

"We established 10 separate committees within the department to address various regulatory aspects, including financial reporting, licensing, oversight, and revenue certification," Rebuck explained. "Crucially, regulated entities were granted representation in these committees, ensuring their involvement in critical policy decisions. We empowered each district to appoint their representatives to these committees."

Throughout his 13-year tenure, Rebuck facilitated constructive dialogue between the state and the casino industry. He emphasized the importance of operators justifying their requests and aligning them with shared objectives. "Operators understood the necessity of robust regulation," Rebuck asserted, highlighting the mutual recognition that regulatory processes require ongoing evaluation and adaptation.

"As we implemented revised rules," Rebuck stated, "I emphasized the importance of ongoing assessment. We committed to testing the effectiveness of new regulations annually to ensure their continued efficacy." Rebuck's proactive approach fostered a culture of collaboration and accountability between regulatory staff and industry operators, ultimately contributing to the advancement of responsible and effective gambling regulation in New Jersey.

In-House Testing Facility in New Jersey: A Cornerstone of Gambling Regulation

Established at the inception of regulatory efforts in the United States, the laboratory was initially tasked with testing slot machines. Today, it plays a pivotal role in reviewing and testing all gambling-related technologies.

In contrast to many other gaming jurisdictions, New Jersey has consistently retained control of its testing processes, opting not to outsource to private entities. This decision has proven fruitful, with the state's laboratory earning a reputation as one of the industry's premier facilities.

Under Rebuck's leadership, the laboratory actively seeks feedback from gaming operators and suppliers, ensuring continuous improvement and effectiveness. The resounding consensus is that the New Jersey laboratory excels in its role.

Given its track record of success, the state remains committed to operating its own testing laboratory, with no plans to deviate from this model. This steadfast approach underscores New Jersey's dedication to maintaining rigorous standards and upholding the integrity of its gambling regulations.

Challenges and Triumphs: David Rebuck's Legacy in New Jersey's Gambling Industry

David Rebuck faced formidable challenges when overseeing the introduction of the gambling sector, which had already been established in New Jersey for over a decade. "We didn't dictate how you (casino operators) would build your business plan. Do whatever you want, as long as it complies with our rules," he remarked.

As Director of the Division of Gaming Enforcement (DGE), Rebuck's impending retirement prompts reflection on his years of service, marked by dedication and effective leadership. His strategic vision and steadfast principles have propelled New Jersey to national leadership within the US gaming industry.

Rebuck and his team recognised early on that the traditional European gambling model, with its lax regulations, would not suffice in New Jersey. They understood the necessity of a tailored approach, especially in light of the industry's evolution towards digital platforms that extended beyond licensed casino operators, akin to Amazon's retail sales model.

European operators' assertion that they could swiftly activate operations contrasted sharply with the intricate regulatory framework required in New Jersey. Rebuck astutely observed, "We’re not a state where you can just flip a switch."

The New Jersey model prioritises licensing for casino operators, empowering them to elevate their offerings and transition digital customers into physical visitors, boosting revenue streams. Notably, the swift implementation of slot machines within nine months exemplifies the state's commitment to efficient regulation and industry growth.

Mentorship: A Pillar of David Rebuck's Legacy

Mentorship stands as a cornerstone of David Rebuck's enduring legacy. As a trusted advisor, Rebuck extends his guidance to regulators across numerous states who seek his expertise. "You think Nevada is the gold standard? No," Rebuck asserts. "We believe New Jersey should be the platinum standard."

Among the invaluable lessons Rebuck imparts to fellow regulators is the paramount importance of effective regulation. He emphasises that robust regulation not only fosters public trust in the gaming industry but also facilitates access to funding from Wall Street banks, thus catalysing the expansion of the gambling sector nationwide.

Continuing a tradition of exemplary leadership within the Division of Gaming Enforcement, Rebuck follows in the footsteps of esteemed predecessors such as G. Michael Brown, Anthony Parrillo, and Tom Auriemma.

David Rebuck's legacy serves as a testament to the notion that regulation of the gambling industry, despite its complexity, is attainable through ongoing dialogue and a steadfast commitment to effective governance. His tenure underscores the vital role that regulation plays in ensuring the success and integrity of the gaming sector.
