Brazil Implements New Betting Regulations

Brazil has unveiled new regulations outlined in the Regulatory Policy of the Secretariat of Prizes and Wagering (SPA) under the Brazilian Ministry of Finance, signaling exceptions for data centers situated beyond the country's borders.

Under Regulatory Decree No. 722, detailed guidelines have been established concerning betting systems, encompassing technological and security requisites. Of significance, the decree elucidates specific circumstances where data centers may operate outside Brazil. In such instances, the entities receiving the data must ensure uniform content across all information sets by utilizing the Brazilian database.

Moreover, operational agents are mandated to formulate robust business continuity plans to address potential data vulnerability scenarios, delineating strategies to mitigate potential loss situations effectively.

As per Regulation No. 722, operators are permitted to operate platforms from overseas provided they adhere to stipulated compliance standards. However, operators are also required to furnish the SPA with comprehensive explanations justifying the utilization of foreign-based systems.
