Legal Challenge Against Florida's Betting Agreement Raises Federal Law Concerns

Miami Law School adjunct professor Daniel L. Wallach has initiated a legal challenge against the betting agreement between Florida's Seminole tribe and the state government. Wallach has filed a lawsuit, urging the U.S. Supreme Court to review the agreement, claiming that it violates federal law.

The focus of the case revolves around the Indian Gaming Regulatory Act (IGRA). Wallach argues that the 2021 compact, signed by Florida Governor Ron DeSantis and the Seminole Tribe, exceeds the boundaries set by IGRA. The compact permits the tribe to conduct online sports betting throughout the state, surpassing traditional limitations tied to tribal jurisdiction found in other states.

Wallack is pushing for a comprehensive examination of the agreement's alignment with federal laws. If the Supreme Court opts to hear the case, its decision could establish a precedent that impacts the terms of similar agreements in other states.
